EXPRESS WRITTEN CONSENT TO CONTACT

Welcome to YourImmigrationAttorney.com (the “Site”), operated by Your Immigration Attorney PLLC (the “Firm,” “we,” or “us”). By accessing or using the Site, you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Site. These Terms do not govern any attorney-client relationship; any representation is governed by a separate signed engagement agreement.


1. Not Legal Advice; No Attorney–Client Relationship

Content on the Site is for general information and advertising only and is not legal advice. Viewing the Site, contacting us, or submitting information does not create an attorney–client relationship. Such a relationship arises only after conflicts checks and execution of a written engagement agreement. Do not send confidential information until we confirm representation.


2. Attorney Advertising; Licensing; Jurisdictions

This Site may be considered Attorney Advertising. Prior results do not guarantee a similar outcome. Our attorneys are licensed in one or more U.S. jurisdictions and practice federal immigration law, which generally permits representation regardless of the client’s state or country. We may associate with local counsel as needed. For specific questions about licensing or jurisdiction, contact us.


3. Eligibility and Use of the Site

You must be at least the age of majority in your place of residence to use the Site. You agree to use the Site only for lawful purposes and in compliance with these Terms and all applicable laws.


4. Intellectual Property; Limited License

The Site, including text, graphics, logos, and other content (“Content”), is owned by Your Immigration Attorney PLLC or its licensors and is protected by law. We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, scrape, or create derivative works from the Site without our prior written consent.


5. User Submissions

If you submit information (e.g., forms, emails, uploads), you grant us a non-exclusive license to use that information to evaluate potential representation, provide services, and operate the Site. Do not submit confidential or highly sensitive documents unless we request them through a secure channel. You represent that your submissions are accurate and do not infringe the rights of others.


6. Third-Party Links and Services

The Site may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices.


7. Electronic Communications; E-SIGN Consent; Calls & Texts (TCPA)

By using the Site and providing contact information, you consent to receive electronic communications (including email, SMS, and in-Site notices).
If you submit a form or provide a phone number, you provide express written consent for Your Immigration Attorney PLLC and its service providers to call and text you about immigration law services and potential representation, which may involve an autodialer and/or prerecorded/artificial voice. Message/data rates may apply; frequency varies; reply STOP to opt out, HELP for help; carriers are not liable for delayed or undelivered messages.
You represent that you are the subscriber or customary user of the number provided. Consent is not a condition of obtaining legal services, and you may revoke consent at any time by replying STOP or contacting us at info@yourimmigrationattorney.com. We may still contact you as permitted to respond to your request or as otherwise allowed by law.


8. No Warranties

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR IMMIGRATION ATTORNEY PLLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee the Site will be error-free, secure, or uninterrupted.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR IMMIGRATION ATTORNEY PLLC AND ITS ATTORNEYS, STAFF, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. Some jurisdictions do not allow certain limitations; in such cases, liability will be limited to the maximum extent permitted by law.


10. Indemnification

You agree to defend, indemnify, and hold harmless Your Immigration Attorney PLLC from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms.


11. Dispute Resolution; Arbitration; Class-Action Waiver

Except for disputes concerning an existing or former attorney-client relationship (which are governed by the relevant engagement agreement and professional rules), any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration on an individual basis under the rules of JAMS before a single arbitrator in Miami-Dade County, Florida. No class or representative actions are permitted. You may seek relief in small-claims court if eligible.
Opt-out: You may opt out of arbitration within 30 days of first using the Site by sending a notice to info@yourimmigrationattorney.com with subject “Arbitration Opt-Out.” This Section survives termination.


12. Governing Law; Venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflicts-of-law rules. For any matter not subject to arbitration, the state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction and venue.


13. Accessibility

We aim to make the Site accessible to all users. If you have difficulty accessing content, please contact info@yourimmigrationattorney.com or call (888) 763-8472, and we will work to provide the information you need.


14. Changes to the Site or Terms

We may modify the Site or these Terms at any time. Changes are effective when posted with the “Effective Date” above. Your continued use after changes are posted constitutes acceptance.


15. Termination

We may suspend or terminate your access to the Site at any time for any reason. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, arbitration) will survive termination.


16. Entire Agreement; Severability; Waiver

These Terms (together with our Privacy Policy) are the entire agreement regarding Site use. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain in effect. Our failure to enforce any right is not a waiver.
